Terms of Service

These Terms of Service ("Terms") govern your access to and use of BEDOPE, including our website, applications, AI generation tools, credit system, subscription plans, and related services (together, the "Service").

By creating an account, purchasing credits, subscribing to a plan, uploading content, generating content, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. About the Service

BEDOPE is an AI-powered platform that allows users to create, edit, and manage AI-generated images, videos, audio, avatars, characters, and other digital content using third-party AI models and related technologies.

The Service may include, depending on availability:

• text-to-image generation;
• image-to-image generation;
• text-to-video generation;
• image-to-video generation;
• AI avatar or influencer creation;
• motion transfer, face reference, style reference, or character consistency tools;
• personal galleries or libraries for generated content;
• credit-based access to AI models;
• subscription plans and one-time credit purchases.

We may add, remove, modify, replace, suspend, or discontinue any feature, model, provider, tool, or functionality at any time.

2. Eligibility

You must be at least 18 years old to use the Service.

By using the Service, you confirm that:

• you are at least 18 years old;
• you have legal capacity to enter into these Terms;
• all information you provide is accurate and complete;
• you will use the Service only in compliance with these Terms and applicable law.

We may suspend or terminate accounts if we believe the user is under 18 or has provided false information.

3. Account Registration

Some features require an account. When creating an account, you agree to:

• provide accurate and complete registration information;
• keep your login credentials confidential;
• be responsible for all activity under your account;
• notify us immediately if you suspect unauthorized access;
• not share, sell, rent, transfer, or allow others to use your account.

We are not responsible for losses caused by unauthorized account access resulting from your failure to protect your credentials.

4. Credits and Payments

The Service operates on a credit-based system. Credits are required to generate or process content.

Credits may be purchased through one-time credit packages; through monthly or annual subscription plans; through promotional offers, bonuses, or referral rewards; or through other payment options made available within the Service.

The number of credits required for each generation depends on the selected model, generation type, resolution, duration, quality setting, processing mode, or other parameters shown before or during generation.

By completing a purchase, you agree to pay all applicable fees, taxes, and charges. All prices are displayed before purchase. Prices may change at any time, but changes do not affect purchases already completed.

Payments are processed by third-party payment providers. We do not store full payment card details on our servers.

5. Subscriptions

Subscription plans renew automatically at the end of each billing period unless canceled before the renewal date. By subscribing, you authorize us and our payment processor to charge your selected payment method on a recurring basis.

Your subscription may include a monthly or annual credit allowance; access to selected AI models; priority processing; discounted credit top-ups; and additional features available only to subscribers.

Subscription credits may reset at the beginning of each billing period unless stated otherwise on the pricing page.

Cancellation stops future renewals. Unless required by law or stated in our Refund Policy, cancellation does not automatically refund payments already made, and you may continue to access the subscription until the end of the current billing period.

6. One-Time Credit Purchases

One-time credit packages are separate from subscriptions. One-time credits may be used for eligible generations within the Service. Unless stated otherwise, one-time credits do not include subscription benefits, priority queues, monthly perks, or renewal-based features.

Credits are account-specific and cannot be sold, transferred, exchanged, withdrawn, converted into cash, or assigned to another user.

7. Credit Usage and Failed Generations

Credits may be deducted when a generation request is submitted, processed, completed, or otherwise initiated, depending on the model and feature used.

AI generation may sometimes produce unexpected, low-quality, inaccurate, incomplete, or unusable results. This is part of the nature of generative AI and does not automatically qualify for a refund.

However, if a generation fails due to a technical error on our side and no output is delivered, we may, at our discretion, restore the credits or provide another reasonable solution.

We are not responsible for failed or poor results caused by unclear, contradictory, or unsuitable prompts; low-quality uploaded images; unsupported input files; user error; third-party AI model limitations; content moderation restrictions; or attempts to generate prohibited content.

8. User Content

"User Content" means any prompt, text, image, video, audio, file, reference, instruction, or other material you upload, submit, provide, or process through the Service.

You retain ownership of your User Content. You are solely responsible for ensuring that you have all rights, licenses, permissions, and consents needed to upload, process, and use your User Content.

You must not upload or process content that infringes the rights of others, violates privacy rights, violates publicity rights, contains unlawful material, or violates these Terms.

By submitting User Content, you grant us a limited, non-exclusive, worldwide license to host, process, transmit, reproduce, modify, display, and use your User Content only as necessary to provide, operate, secure, and improve the Service, including transmitting it to third-party AI model providers.

Unless expressly stated otherwise, we do not claim ownership of your User Content.

9. AI-Generated Output

"Output" means any image, video, audio, text, avatar, character, or other content generated through the Service.

Subject to these Terms, applicable law, and third-party model provider terms, you may use Output for personal or commercial purposes.

You acknowledge that AI-generated content may not be protected by copyright in all jurisdictions; similar or identical outputs may be generated for other users; we cannot guarantee exclusivity, originality, legal protectability, or uniqueness of any Output; you are responsible for reviewing Output before publishing, selling, distributing, or using it commercially; and you are responsible for ensuring that your use of Output complies with applicable law and third-party rights.

We do not guarantee that any Output will be suitable for your intended purpose.

10. Third-Party AI Models and Providers

The Service may rely on third-party AI models, APIs, infrastructure providers, payment processors, cloud providers, and other service providers. Third-party models may be updated, modified, restricted, suspended, discontinued, or made unavailable at any time.

We do not control third-party AI models and cannot guarantee uninterrupted availability; consistent generation quality; identical results from the same prompt; model accuracy; processing speed; compatibility with all prompts or inputs; or continued access to any specific model.

Your use of certain features may also be subject to third-party provider terms.

11. Prohibited Use

You must not use the Service to create, upload, process, request, distribute, or facilitate content that:

• is illegal, harmful, abusive, threatening, harassing, defamatory, hateful, discriminatory, or violent;
• exploits, sexualizes, harms, or endangers minors;
• depicts minors in sexual, suggestive, exploitative, or inappropriate contexts;
• creates non-consensual intimate imagery;
• creates sexualized deepfakes or impersonations of real people without explicit consent;
• impersonates another person in a misleading, harmful, or fraudulent way;
• infringes copyright, trademark, privacy, publicity, or other rights;
• promotes terrorism, extremism, self-harm, or criminal activity;
• contains malware, phishing, scams, fraud, or deceptive activity;
• attempts to bypass safety systems, filters, moderation, usage limits, or credit requirements;
• scrapes, reverse engineers, overloads, attacks, or disrupts the Service;
• resells access to the Service without our written permission;
• uses the Service to build, train, or improve a competing product without our written permission.

We may block, remove, restrict, or refuse to process any content or request that we believe violates these Terms.

12. Real People, Likeness, and Consent

You must not upload, process, generate, imitate, or transform the likeness of a real person unless you have the legal right and explicit consent to do so.

You are responsible for obtaining all required permissions from any person whose face, body, voice, identity, likeness, or personal characteristics are used in the Service.

We may remove or restrict content if we believe it violates privacy, publicity, consent, or safety rules.

13. Content Moderation

We may review, block, remove, restrict, or disable access to User Content or Output if we believe it violates these Terms, applicable law, third-party rights, or platform safety requirements.

We may suspend or terminate accounts that repeatedly violate our policies. We are not required to monitor all content, but we may do so for safety, legal, fraud prevention, abuse prevention, and service integrity purposes.

14. Availability and Service Changes

The Service is provided on an "as available" basis. We may experience downtime, delays, errors, failed generations, queue congestion, third-party outages, maintenance, or model unavailability.

We may modify, suspend, restrict, or discontinue any part of the Service at any time, including models, pricing, credit costs, subscription features, generation limits, and storage features.

15. Intellectual Property

The Service, website, software, interface, branding, logos, designs, systems, workflows, documentation, and all related intellectual property belong to BEDOPE or our licensors.

You may not copy, modify, reverse engineer, reproduce, sell, rent, distribute, or create derivative works from the Service except as expressly allowed by these Terms.

16. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, error-free, or always available; that generated content will meet your expectations; that generated content will be accurate, lawful, original, exclusive, or commercially usable; that defects will be corrected within any specific timeframe; that any model or feature will remain available; or that your content will never be lost, deleted, corrupted, or restricted.

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

17. Limitation of Liability

To the fullest extent permitted by law, BEDOPE and its owners, directors, employees, contractors, partners, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of goodwill, business interruption, or reputational harm.

Our total liability for any claim related to the Service will not exceed the amount you paid to us during the three months before the event giving rise to the claim, or EUR 100, whichever is greater.

Nothing in these Terms limits liability where such limitation is not permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless BEDOPE and its owners, directors, employees, contractors, partners, affiliates, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the Service; your User Content; your Output; your violation of these Terms; your violation of law; your infringement of third-party rights; or your use of real persons' likenesses without required consent.

19. Account Suspension and Termination

We may suspend, restrict, or terminate your account at any time if you violate these Terms; your activity creates legal, security, fraud, safety, or operational risk; required by law, court order, payment processor, or third-party provider; you misuse credits, subscriptions, referrals, promotions, or technical systems; or your payment is reversed, disputed, declined, or suspected to be fraudulent.

You may delete your account at any time by contacting us. Upon termination, your right to use the Service ends. Unused credits may be forfeited if your account is terminated for violation of these Terms.

20. Governing Law

These Terms are governed by applicable law, without regard to conflict of law rules.

If you are a consumer in the European Union, nothing in these Terms limits any mandatory consumer protection rights available to you under the laws of your country of residence.
